Welcome to Rankpage Sdn Bhd (“Rankpage”, “we”, “us”, “our”).

These Website Terms of Use (“Terms”) govern your access to and use of Rankpage’s website and any webpages, content, features or functionality made available through it (the “Website”).

By accessing or using the Website, you represent and warrant that: (a) if you are an individual, you are at least 18 years old (or, if you are under 18, you have the consent of your parent or legal guardian) and you have the legal capacity to agree to these Terms; and (b) if you are accessing or using the Website on behalf of a company or other entity, you have authority to bind that entity to these Terms, and references to “you” and “your” in these Terms include that entity.

You further acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Website. These Terms apply from the time you first access the Website and continue for as long as you use it.

If you engage Rankpage for paid services, separate service-specific engagement documents (for example, a service agreement, proposal/quotation, scope of work and/or other written engagement documents) may apply in addition to these Terms. To the extent of any inconsistency between these Terms and the service-specific engagement documents for paid services, the service-specific engagement documents will prevail in relation to those paid services.

  1. DEFINITIONS AND INTERPRETATION
    1. In these Terms, unless the context otherwise requires:“Business Day” means a day (other than Saturday, Sunday or public holiday) on which banks in Kuala Lumpur, Malaysia are open for business.

      Comments” means any reviews, comments, feedback, messages or other user-generated content submitted, posted or otherwise made available by you through the Website (if such functionality is enabled).

      Content” means any text, graphics, images, videos, logos, trademarks, designs, layout, software, code and other materials made available on the Website.

      Intellectual Proerty Rights” means all intellectual property rights (whether registered or unregistered) including copyright, trade marks, patents, rights in designs, database rights, trade secrets, confidential information and all similar rights (and applications for such rights) anywhere in the world.

      Rankpage Marks” means the name “Rankpage”, and any Rankpage trade marks, logos, service marks, trade names, domain names and other brand identifiers used by Rankpage from time to time.

      User Content” means any content you submit, upload, post or otherwise make available through the Website (if applicable), including Comments.

      You” / “your” means any person who accesses or uses the Website.

      Party” / “Parties” refers to you and Rankpage collectively, where the context requires.

      Privacy Policy” means Rankpage’s privacy policy as published on the Website (as updated from time to time).

      Website Features” means any interactive features made available on the Website from time to time, including comment functions, chat functions, forms, forums, uploads or any other submission tools, including the submission of User Content and/or Comments.

    2. Interpretation:
      Unless the context otherwise requires:

      (a) Headings are for convenience only and do not affect interpretation.

      (b) Words in the singular include the plural and vice versa.

      (c) References to “including” are without limitation.

      (d) References to a “person” include an individual, company, partnership, association, trust, government body or other legal entity.

      (e) A reference to a clause includes its sub-clauses.

      (f) A reference to “writing” includes email and other electronic communications capable of being recorded and reproduced.

      (g) If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision is deemed modified to the minimum extent necessary to make it valid and enforceable; and if modification is not possible, it is severed. The remaining provisions remain in full force and effect.

  2. COOKIES
    We use cookies and similar technologies (such as pixels, tags and local storage) on the Website. By accessing or using the Website, you acknowledge that cookies which are strictly necessary for the operation, security and functionality of the Website may be placed, and you consent (where required by applicable law) to the use of other cookies and similar technologies in accordance with our Privacy Policy. Please refer to our Privacy Policy (and any cookie notice/settings made available on the Website) for further information on cookies we use, their purposes, retention periods (where applicable), and how you can manage your preferences (including withdrawing consent where applicable).Some cookies may be set by third parties (for example, analytics or embedded content providers). We do not control third-party cookies and your use of third-party services is subject to their terms and policies. Third parties may collect information about your online activities over time and across different websites when you use the Website. You may also be able to control cookies through your browser settings; however, disabling or blocking cookies may affect the availability or functionality of the Website.
  3. ACCEPTABLE USE
    You may access and use the Website only for lawful purposes and in accordance with these Terms. You must not:

    (a) use the Website in any way that breaches any applicable laws or regulations;

    (b) introduce viruses, malware, ransomware or other harmful code or engage in any activity that could disable, overburden, damage or impair the Website or any systems supporting it;

    (c) attempt to gain unauthorised access to the Website, any user accounts (if any), servers or systems or attempt to bypass, disable or interfere with any security-related features of the Website;

    (d) interfere with, disrupt or overload the Website (including by scraping, crawling, harvesting, automated queries, bots, data mining, or denial-of-service activity, except where expressly permitted by us in writing);

    (e) use the Website to transmit or make available unlawful, defamatory, obscene, misleading or infringing material;

    (f) use the Website in a way that infringes any third-party rights (including Intellectual Property Rights);

    (g) use the Website to send or upload unsolicited promotional content (spam) or to impersonate any person or entity, or misrepresent your affiliation with any person or entity;

    (h) use any automated means to access, monitor or copy any part of the Website, or to extract Content, except where expressly permitted by us in writing; or

    (i) use the Website in any manner that is fraudulent, misleading, abusive, harassing or otherwise objectionable (as reasonably determined by us).

    We may restrict, suspend or terminate your access to the Website (in whole or in part) at any time and without notice if we reasonably believe you have breached these Terms, or where required for security, operational or legal reasons. We may also take any other action we consider reasonably necessary or appropriate, including reporting unlawful activity to relevant authorities.

  4. INTELLECTUAL PROPERTY AND PERMITTED USE
    1. Ownership. Unless otherwise stated, Rankpage (and/or its licensors) owns all Intellectual Property Rights in the Website, the Content and the Rankpage Marks. All rights are reserved. For clarity, nothing on the Website should be construed as granting (by implication, estoppel or otherwise) any licence or right to use any Intellectual Property Rights except as expressly set out in these Terms.
    2. Limited Licence. Subject to these Terms, Rankpage grants you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website and Content for your personal and/or internal business use only and not for any commercial exploitation. For clarity, “internal business use” includes using the Website and Content for internal reference, evaluation of Rankpage and/or understanding Rankpage’s services, but does not permit you to reproduce, distribute, publish, sell, resell or otherwise commercially exploit the Website or Content outside your organisation. You may download or print excerpts of Content only to the extent reasonably necessary for such permitted use, provided you keep all proprietary notices intact.
    3. Restrictions. You must not (and must not allow any other person to):

      (a) republish material from the Website;

      (b) sell, rent, or sub-license material from the Website;

      (c) reproduce, duplicate, copy, distribute or exploit Content for commercial purposes (including any external commercial purpose such as resale, redistribution, commercial publication, or making Content available to third parties for a fee or other benefit);

      (d) remove or alter any copyright, trademark or proprietary notices;

      (e) use the Rankpage Marks without our prior written consent; or

      (f) modify, adapt, translate, create derivative works from, reverse engineer, decompile or disassemble any part of the Website or Content, except to the extent permitted by applicable law.

    4. No Transfer. Nothing in these Terms transfers any Intellectual Property Rights to you. All rights not expressly granted are reserved.
    5. Suspension/Termination of Licence. This licence may be suspended or terminated immediately if you breach these Terms. Upon termination, you must stop using the Website and, where reasonably practicable, delete or destroy any copies of Content you have downloaded or printed (except where retention is required by law).
  5. USER CONTENT/COMMENTS
    1. User Content Responsibility. You are solely responsible for your User Content. You must ensure that any User Content you submit is lawful, not false or deceptive, accurate (where stated as fact), not misleading, and does not infringe any third-party rights. You acknowledge that Rankpage has no obligation to back up or retain any User Content and may delete it at any time.
    2. Moderation. Where the Website allows User Content/Comments, Rankpage does not generally pre-screen User Content, and User Content does not reflect Rankpage’s views or opinions. Rankpage does not guarantee that any User Content will be published or remain available.
    3. Removal. Rankpage reserves the right (but has no obligation) to monitor, edit, remove or disable access to any User Content/Comments at any time and without notice if we consider it inappropriate, offensive, unlawful, misleading, infringing, spam, irrelevant, impersonating others, containing malware, or in breach of these Terms. Rankpage may also suspend or terminate your access to any interactive features of the Website in accordance with Clause 3 (Acceptable Use).
    4. Your Warranties. You warrant and represent that:

      (a) you are entitled to post the User Content/Comments and have all necessary authorisation, licences and consents to do so;

      (b) the User Content/Comments do not infringe any Intellectual Property Rights or other rights of any third party;

      (c) the User Content/Comments do not contain defamatory, abusive, obscene or otherwise unlawful material;

      (d) the User Content/Comments will not be used to solicit or promote business, custom, or present commercial or unlawful activities without our prior written consent; and

      (e) the User Content/Comments do not include any confidential information, personal data of third parties (unless you have lawful authority/consent to disclose it), or content that may expose Rankpage to legal or regulatory risk.

    5. Licence to Rankpage. By submitting User Content, you grant Rankpage a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, display, publish, adapt, edit and distribute such User Content for the purposes of operating, improving and promoting the Website (and Rankpage’s business), in any media. This licence includes the right for Rankpage to make your User Content available to the public (where the relevant feature is public-facing) and to use your User Content in marketing or promotional materials, provided Rankpage will not attribute your User Content to you by name unless (i) your username is displayed as part of the Website feature; or (ii) you have otherwise agreed in writing. You waive (to the extent permitted by applicable law) any “moral rights” or equivalent rights in your User Content.
    6. Takedown and Complaints. If you believe any User Content infringes your rights or is unlawful, please contact Rankpage using the contact details on the Website with sufficient information for us to assess the complaint (including the URL/location and a description of the issue). Rankpage may remove or disable access to the relevant User Content at its discretion.
    7. No Confidential Submissions. Information submitted via the Website (including via forms, chat functions or email links) is not confidential and does not create any client-consultant, fiduciary or other professional relationship, except to the extent Rankpage expressly agrees otherwise in writing (for example, under a separate non-disclosure agreement). Rankpage will handle any personal data submitted via the Website in accordance with the Privacy Policy.
    8. Indemnity in respect of User Content. You agree to indemnify and hold harmless Rankpage (including its directors, officers, employees, agents and contractors) from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to your User Content/Comments, including any allegation that your User Content/Comments are unlawful, defamatory, misleading, infringing, or violate any third-party rights or applicable laws.
    9. Feedback. If you submit any suggestions, ideas, enhancement requests or other feedback to Rankpage regarding the Website, Content or Rankpage’s services (whether via the Website or otherwise), you agree that Rankpage may use, implement, disclose and exploit such feedback for any purpose, without restriction and without any compensation or attribution to you.
  6. HYPERLINKING TO OUR CONTENT
    1. Permitted Links Without Prior Approval. The following organisations may link to our Website without prior written approval, provided they comply with Clause 6.2:

      (a) government agencies;

      (b) search engines;

      (c) news organisations;

      (d) online directory distributors (in the same manner as they hyperlink to other listed businesses); and

      (e) Systemwide Accredited Businesses (except soliciting non-profit organisations, charity shopping malls, and charity fundraising groups).

    2. Conditions for Linking. Organisations permitted under Clause 6.1 may link to our home page, to publications, or other Website information, provided that the link:

      (a) is not deceptive or misleading;

      (b) does not falsely imply sponsorship, endorsement, partnership, affiliation, or approval by Rankpage; and

      (c) fits within the context of the linking party’s site and is not placed on any website or page containing unlawful, defamatory, obscene, infringing or harmful content.

    3. Other Link Requests. We may, at our discretion, consider and approve other link requests from organisations such as consumer/business information sources, dot.com community sites, associations representing charities, internet portals, professional firms and educational institutions. We may require additional information, conditions or a written linking permission before approval is granted.
    4. Withdrawal of Permission. We may withdraw linking permission at any time (in whole or in part) without notice, and you must remove any link upon our request within a reasonable time (and in any event within five (5) Business Days).
    5. Request Process. If you wish to link to our Website and you are not covered by Clause 6.1, please contact us using the details in Clause 15 and include (i) your organisation name and contact details, (ii) the URL(s) of your website where the link will appear, and (iii) the page(s) on our Website you intend to link to. Any approval is effective only if confirmed by Rankpage in writing and may be subject to conditions.
    6. No Use of Rankpage Marks. No use of Rankpage Marks, logo or artwork is allowed for linking without our prior written consent. For the avoidance of doubt, you must not use “Rankpage” or any Rankpage Marks in a way that suggests endorsement, sponsorship or affiliation.
    7. No Framing. Without Rankpage’s prior written consent, you must not frame, mirror, embed or otherwise alter the visual presentation of any part of the Website. For further details, see Clause 7.
  7. IFRAMES / FRAMING
    Without Rankpage’s prior written consent, you must not frame, inline frame (iframe), embed, or otherwise display any part of the Website within another website, application, or service in a manner that changes, overlays, obscures, crops, or otherwise alters the visual presentation, branding, content, functionality, or user experience of the Website, or that suggests any association, sponsorship or endorsement by Rankpage.
  8. CONTENT AND LINKING LIABILITY
    1. Your Responsibility. If you link to the Website, you are solely responsible for: (a) the content, operation and security of your website (or platform); and (b) ensuring that any link to the Website complies with these Terms and all applicable laws and regulations.
    2. No Misleading Association. You must not create a link to the Website in any manner that is deceptive, misleading, or that suggests any association, sponsorship, endorsement or approval by Rankpage where none exists. You must not link to the Website from (or in connection with) any content that is unlawful, defamatory, obscene, misleading, infringing, or otherwise objectionable.
    3. Indemnity. You agree to indemnify and hold harmless Rankpage (including its directors, officers, employees and agents) from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) any content on, or use of, your website (or platform); (b) any allegation that your website (or the linking to the Website) infringes any third-party rights or violates any law; and/or (c) your breach of this Clause 8.
    4. Survival. This Clause 8 survives termination or expiry of these Terms.
  9. YOUR PRIVACY
    1. Privacy Policy. Your use of the Website is subject to our Privacy Policy, which explains how we collect, use, disclose and protect personal data, and how cookies and similar technologies may be used.
    2. Acknowledgement. By accessing or using the Website, you acknowledge that you have read and understood the Privacy Policy.
    3. Updates. We may update our Privacy Policy from time to time. The version published on the Website at the relevant time will apply.
  10. RESERVATION OF RIGHTS
    1. Right to Require Removal of Links. We reserve the right, at any time and in our discretion, to request that you remove any link (or all links) to the Website. You must comply with any such request promptly and, in any event, within a reasonable time (or within any timeframe we specify).
    2. Withdrawal of Linking Permission. Without limiting Clause 10.1, we may withdraw any permission to link to the Website (whether express or implied) at any time without notice.
    3. Changes to These Terms. We may amend or update these Terms from time to time by posting the updated Terms on the Website. Unless otherwise stated, the updated Terms take effect from the date they are posted. By continuing to access or use the Website after the updated Terms are posted, you agree to be bound by them.
    4. No Waiver. Our failure to enforce any right under these Terms does not constitute a waiver of that right.
  11. WEBSITE CONTENT, AVAILABILITY AND SECURITY
    1. If you identify any link on the Website that you consider offensive, unlawful, infringing, or otherwise inappropriate, you may notify us using the contact details stated on the Website (or in Clause 15). We will consider such requests, but we do not guarantee that we will remove any link and we are not obliged to respond to every request.
    2. The Website and Content are provided for general information only. While we take reasonable care in preparing the Content, we do not warrant or represent that any Content is accurate, complete, current, reliable or error-free, and you rely on the Website and Content at your own risk.
    3. We do not guarantee that the Website will always be available, uninterrupted, secure or free from errors. We may, at any time and without notice, suspend, withdraw, discontinue, restrict access to, or change (in whole or in part) the Website and/or any Content for operational, maintenance, security, legal or business reasons, and we will not be liable for any loss or damage arising from any such unavailability, suspension, withdrawal, discontinuance, restriction or change (to the maximum extent permitted by law).
    4. We do not warrant that the Website, Content, or any download from the Website will be free from viruses, malware, ransomware or other harmful components. You are responsible for implementing appropriate safeguards (including anti-virus and security checks) to protect your device, systems and data.

    1. The Website may contain links to, integrations with, or references to third-party websites, tools, content or services (collectively, “Third-Party Services”). Third-Party Services are provided for convenience and informational purposes only.
    2. Rankpage does not own, operate or control any Third-Party Services, and does not endorse, approve or assume responsibility for any Third-Party Services (including their content, availability, security, functionality, accuracy, privacy practices, terms, or policies).
    3. Your access to or use of any Third-Party Services is at your own risk and may be subject to the third party’s own terms, policies and fees. You should review those terms and policies before using any Third-Party Services.
    4. To the maximum extent permitted by law, Rankpage is not liable for any loss or damage arising from or relating to your access to or use of any Third-Party Services, or any act, omission, error, interruption, suspension or conduct of any third party.
  13. DISCLAIMER
    1. No Warranties. To the maximum extent permitted by applicable law, Rankpage excludes all representations, warranties and conditions (whether express, implied or statutory) relating to the Website, the Content and your access to or use of them, including any implied warranties of merchantability, satisfactory quality, fitness for purpose, non-infringement, compatibility, security and accuracy.
    2. “As Is” / “As Available”. The Website and Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Rankpage does not warrant or represent that:

      (a) the Website will be available, uninterrupted, timely, secure or error-free;

      (b) any defects will be corrected;

      (c) the Website or any server used to make it available is free of viruses, malware or other harmful components; or

      (d) the Content is complete, accurate, up to date, reliable or suitable for any purpose.

    3. No Reliance. Any reliance you place on the Website or Content is at your own risk. You are responsible for obtaining your own professional advice before acting on any information made available on or through the Website.
    4. Third Parties. Without limiting Clause 12 (Third-Party Links and Third-Party Services), Rankpage is not responsible for any third-party content, websites, tools or services, or any loss or damage arising from your access to or use of them.
    5. Non-Excludable Liability. Nothing in these Terms excludes or limits liability for:

      (a) death or personal injury caused by negligence;

      (b) fraud or fraudulent misrepresentation; or

      (c) any other liability that cannot be excluded or limited under applicable law.

    6. Effect of Disclaimer. The limitations and exclusions in this Clause 13:

      (a) are subject to Clause 13.5; and

      (b) apply to all claims and liabilities arising out of or in connection with the Website or these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise.

    7. Exclusion of Certain Losses; Free-of-Charge Basis. To the maximum extent permitted by law and subject always to Clause 13.5, Rankpage will not be liable for any indirect, incidental, special, exemplary, punitive or consequential loss or damage, or any loss of profit, revenue, business, goodwill, anticipated savings, or data, arising out of or in connection with the Website or these Terms. Further, to the maximum extent permitted by law and subject always to Clause 13.5, Rankpage will not be liable for any loss or damage of any kind arising from or in connection with the Website or your use of it, to the extent the Website and information on it are provided free of charge.
    8. Liability Cap. To the maximum extent permitted by law and subject always to Clause 13.5, Rankpage’s total aggregate liability for all claims arising out of or in connection with the Website or these Terms (whether in contract, tort (including negligence), breach of statutory duty or otherwise) is limited to RM100.
  14. GOVERNING LAW AND JURISDICTION
    These Terms are governed by the laws of Malaysia, without regard to conflict of law principles. You irrevocably submit to the non-exclusive jurisdiction of the Malaysian courts for any dispute or claim arising out of or in connection with these Terms, the Website or your use of the Website.
